Staging a landmark visit to Yerevan, FM Davutoğlu declares the Ottoman deportation of Armenians in 1915 to have been ‘wrong’ and ‘inhumane’

The “deportation” of Armenians in 1915 was inhumane, and Turkey has never supported the move, Foreign Minister Ahmet Davutoğlu said yesterday as he made a landmark visit to the country’s long-time foe, Armenia.

Accompanied by Foreign Ministry Undersecretary Feridun Sinirlioğlu, Davutoğlu visited Yerevan for the Black Sea Economic Cooperation (BSEC) group meeting. The top diplomat met with his Armenian counterpart, Edward Nalbandian, on the sidelines of the summit.
“We are very pleased with the meeting with Nalbandian; it was candid. The primary aim is to build an environment of dialogue on a strong basis,” Davutoğlu said after the meeting, while dismissing claims that he suggested to Armenia that it withdraw from two regions in Nagorno-Karabakh.

Davutoğlu expressed his hope that a collective consciousness between the two countries could be created with a “just memory.”

“We say ‘just memory.’ What I mean with that is we should know the facts. Then we see that Turkish-Armenian relations do not date back like German-Jewish ties. In every street, there is a common sign. After you discover this, then you see the deportation, which I see as a totally wrong practice done by [the Ottoman-era rulers under the Committee of Union and Progress]. It was inhumane,” Davutoğlu told a group of reporters en route to Yerevan.
Yerevan wants Ankara to recognize the mass killings of Armenians during the forced deportation in World War I as genocide, but Turkey has steadfastly refused to do so.
“But when you write a history taking the deportation into account, then a collective conscious was created from this side [Turkey] that Armenians betrayed their nation and deserved the deportation. We should destroy these two collective consciousnesses. We abolished this wrong consciousness in 2005, but Armenians still have it,” he told reporters.

Primary aim not to open border
“Our primary aim is not open only the Turkish-Armenian border but to form a foundation that will pave the way for a comprehensive peace,” Davutoğlu said. “It has three pillars. The first one is relations between Turkey and Armenia. The second one is Azerbaijani-Armenian relations. This also includes Georgian-Abkhaz ties. The third one is relations between Turks and Armenians,” he said.

Turkey and Armenia signed protocols in 2009 to establish diplomatic relations and open their sealed borders, but neither succeeded in completing the process for different reasons.
“If one of the pillars is crippled, it will create distress. Let’s say we opened the Armenian border gate. If a war breaks out between Armenia and Azerbaijan, then we would be forced to close it again. The hardest thing is to defrost the iceberg of the status quo. You could start a war when you trying to defrost it,” he said.

The foreign minister said they were holding talks with the Armenian diaspora but were not publicizing the matter. “In the past, talking with the diaspora has been perceived as a threat or aimed for intelligence issues. Diplomats thought, ‘What would I do?’ if it were recorded. But now it has become a duty. Since that time, whenever I go abroad I meet with the Armenian community if there is one. We don’t publicly announce the people we meet due to the fact that extremist Armenians would cause problems,” he said. “What we realize is that if you cannot provide a basis in ties with the diaspora, that puts pressure on ties with Armenia and it becomes deadlocked.”

Obama Wins Liar of the Year Award

It’s probably not the kind of recognition he wanted to receive, but President Barack Obama has been awarded PolitiFact’s “Lie of the Year” for 2013.

The infamous prize, handed out annually by the fact-checking website PolitiFact, was given to Obama because of his statements claiming that Americans would be able to keep their health insurance under the Affordable Care Act if they liked their plan.

“If you like your health care plan, you can keep it,” Obama said on numerous occasions over the years. Soon after cancellation notices began arriving in American mailboxes this fall – more than four million people have seen their coverage cancelled at this point, largely due to the fact that their coverage did not reach the ACA’s minimum requirements – Obama denied that such a promise was made, saying he actually meant that plans could be kept only if they hadn’t changed since the health care law was passed.

Obama’s explanation didn’t pass muster, however, especially since he’d been captured on video promising that health care plans would stay in place at least two dozen times. Facing public backlash, Obama apologized and unveiled a one-year plan to allow insurers keep selling existing plans that are about to be cancelled.

This article was first published in French in the Monde diplomatique in April 1997. It was subsequently published in the African Journal of Political Economy and in the author’s book: The Globalization of Poverty and the New World Order. 

The policy of land expropriation in Mozambique leading to the establishment of White Afrikaner farms using indentured Mozambican farm workers had the support of the ANC government. It also had the the personal blessing of President Nelson Mandela “who had delegated Mpumalanga Premier Matthews Phosa to the SACADA Board of Governors.

Premier Phosa, a distinguished ANC politician and among the most prosperous black businessmen in Mpumalanga province (East Transvaal), contributed to laying the political ground work for the expansion of White Afrikaner business interests into neighbouring countries.  

The SACADA project was coordinated by the leader of the right wing Freedom Front and former South African Defense Force Chief General Constand Viljoen

Viljoen developed a close personal relationship with Nelson Mandela. He had convinced Mandela that  promoting White Afrikaner  farms in neighbouring countries “would provide food and employment for locals”.  What was not discussed was that this ANC government policy implied a de facto process of land expropriation which went against the basic tenets of the ANC’s struggle for land rights for African peasants.

From the outset, international corporate agribusiness and the World Bank  were involved in this project. It is worth noting that during the period of “Transition” preceding the 1994 presidential elections, General Constand Viljoen had been “plotting an Afrikaner guerrilla war against multiracial rule”. While Mandela “believed in action” … at the core of [his] militancy was always a desire to get the white colonial regime to come to the table and talk.” (Mail and Guardian, December 12, 2013). This stance largely characterized his relationship  with General Viljoen.

It is worth noting that in the 1980s General Viljoen as Chief of the South African Defence Force led South African troops into Angola. In 1993, he participated in the establishment of the Right wing racist Afrikaner Volksfront (AVF).  He later formed the Freedom Front Party which presented candidates to the April 1994 elections.

Its publication in Le Monde diplomatique in April 1997 coincided with the hearings of the South Africa Truth Commission led by Rev Desmond Tutu, which focused on the role of General Constand Viljoen as South African Defense Force Chief during the Apartheid period. (General Viljoen testified in May 1997 before the Truth Commission

The article was the object of a June 1997 law suit claiming defamation directed against the author and Le Monde diplomatique by the South African Chamber for Agricultural Development (SACADA)  and the leader of the Freedom Front and former SADF Chief General Constand Viljoen. 

The law suit launched in Paris was subsequently thrown out by the Paris Court of Justice.

Exporting Apartheid to Sub-Saharan Africa

The right wing Afrikaner Freedom Front (FF) headed by General Constand Viljoen plans to develop a “Food Corridor” extending across the Southern part of the continent from Angola to Mozambique. Afrikaner agri-business is to extend its grip into neighbouring countries with large scale investments in commercial farming, food processing and eco-tourism. The agricultural unions of the Orange Free State and Eastern Transvaal are partners; the objective is to set up White-owned farms beyond South Africa’s borders.

The “Food Corridor,” however, does not mean “food for the local people.” On the contrary, under the scheme the peasants will lose their land, with small-holders becoming farm labourers or tenants on large scale plantations owned by the Boers. Moreover, the South African Chamber for Agricultural Development (SACADA) which acts as an umbrella organization also includes, centrally, several right wing organizations including the Freedom Front (FF) led by Viljoen, whose grim record as South African Defence Force (SADF) Commander in Chief during the Apartheid regime is well known.

The Freedom Front, although “moderate” in comparison to Eugene Terre’Blanche’s far-right Afrikaner Weerstandsbeweging (AWB), is a racist political movement committed to the Afrikaner Volksstaat. The SACADA-Freedom Front initiative has nonetheless the political backing of the African National Congress as well as the personal blessing of President Nelson Mandela who has delegated Mpumalanga Premier Matthews Phosa to the SACADA Board of Governors. All the other governors are members of the Freedom Front. Premier Phosa, a distinguished ANC politician and among the most prosperous black businessmen in Mpumalanga province (East Transvaal), has also contributed to laying the political ground work for the expansion of White Afrikaner business interests into neighbouring countries.

In discussions with President Mandela, General Viljoen had argued that “settling Afrikaner farmers would stimulate the economies of neighbouring states, would provide food and employment for locals, and that this would stem the flow of illegal immigrants into South Africa.” Viljoen has also held high level meetings on Afrikaner agricultural investments with representatives of the European Union, the United Nations and other donor agencies.

In turn, Pretoria is negotiating with several African governments on behalf of SACADA and the Freedom Front. The ANC government is anxious to facilitate the expansion of corporate agri-business into neighbouring countries. As one newspaper account affirms, “Mandela has asked the Tanzanian government to accept Afrikaner farmers to help develop the agricultural sector” while SACADA itself has approached some 12 African countries “interested in White South African farmers.” In a venture set up in 1994 under the South African Development Corporation (SADEVCO), the government of the Congo had granted to the Boers 99 year leases on agricultural land; President Mandela endorsed the scheme calling on African nations “to accept the migrants as a kind of foreign aid.”

The African host countries have on the whole welcomed the inflow of Afrikaner investments. With regard to regulatory policies, however, the Bretton Woods institutions and the World Trade Organization (WTO) (rather than national governments) call the shots, invariably requiring (indebted) countries to accept “a wide open door to foreign capital.” In this context, the liberalization of trade and investment under donor supervision, tends to support the extension of Afrikaner business interests throughout the region. Moreover, in the sleazy environment shaped by transnational corporations and international creditors, corrupt politicians and senior bureaucrats are often co-opted or invited to become the “business partners” of South African and other foreign investors.

The expropriation of peasant lands

The “Food Corridor” initiative will displace a pre-existing agricultural system: it not only appropriates the land, it takes over the host country’s economic and social infrastructure and, almost inevitably, spells increased levels of poverty in the countryside. It will most likely provide a fatal blow to subsistence agriculture as well as to the peasant cash crop economy, displacing local level agricultural markets and aggravating the conditions of endemic famine prevailing in the region. As if this were not enough, Jen Kelenga, a spokesperson for a pro-democracy group in Zaire, also sees, at the heart of the initiative, the Boers “in search of new territories to apply their racist way of living.”

The “Food Corridor” if carried through, could potentially alter the rural landscape of the Southern African region, requiring the uprooting and displacement of small farmers over an extensive territory. Under the proposed scheme, millions of hectares of the best farmland would be handed over to South African agri-business. The Boers are to manage large scale commercial farms using the rural people both as “labour tenants” as well as seasonal agricultural workers.

Such initiatives also dovetail with World Bank directives regarding land-use in the region. Indeed, the Bank has pressed for land legislation throughout Sub-Saharan Africa that would abrogate the right to land of millions of small-holders, with identical land legislation now being enforced throughout the region. The national level land laws (drafted under technical advice from World Bank Legal Department) are with some variations “exact carbon copies of each other”:

“The constitution [in Mozambique] says that the land is the property of the State and cannot be sold or mortgaged. There has been strong pressure particularly from the United States and the World Bank for land to be privatized and to allow mortgages …”

Under the proposed land legislation, both SACADA and the World Bank nonetheless tout the protection of traditional land rights. The small peasantry is to be “protected” through the establishment of “customary land reserves” established in the immediate vicinity of the White commercial farms. In practice, under the new land legislation, the majority of the rural people will be caged into small territorial enclaves (“communal lands”) while the bulk of the best agricultural land will be sold or leased to private investors.

This also means that peasant communities which practice shifting cultivation over a large land area, as well as pastoralists, will henceforth be prosecuted for encroaching on lands earmarked for commercial farming, often without their prior knowledge. Impoverished by the macro-economic reforms, with no access to credit and modern farm inputs, these customary enclaves will, as noted, constitute “labour reserves” for large scale agri-business.

Afrikaner farms in Mozambique

SACADA has plans to invest in Mozambique, Zaire, Zambia and Angola, “with Mozambique being the test case.” President Joaquim Chissano of Mozambique and President Nelson Mandela (1994 picture right) signed an intergovernmental agreement in May 1996 which grants rights to Afrikaner agri-business to develop investments in at least six provinces encompassing territorial concessions of some eight million hectares. According to one South African official:

“Mozambique needs the technical expertise and the money, and we have the people … We favour an area which is not heavily populated because it is an Achilles heel if there are too many people on the land … For the Boers, Land is next to God and the Bible.”

In SACADA’s concessionary areas in Mozambique, the Frelimo government will ensure that there is no encroachment; rural small-holders and subsistence farmers (who invariably do not possess legal land titles) will either be expelled or transferred into marginal lands.

In Mozambique’s Nissan province, the best agricultural land is to be leased in concession to the Afrikaners for fifty years. At the token price of some $0.15 per hectare per annum, the land lease is a give-away. Through the establishment of Mosagrius (a joint venture company), SACADA is now firmly established in the fertile valley of the Lugenda river. But the Boers also have their eyes on agricultural areas along the Zambezi and Limpopo rivers as well as on the road and railway facilities linking Lichinga, Niassa’s capital to the deep seaport of Nagala. The railway line is being rehabilitated and modernized (by a French contractor) with development aid provided by France.

In the initial stage of the agreement, concessionary areas in Niassa province were handed over to SACADA in 1996 to be settled by some 500 White Afrikaner farmers. These lands are earmarked for commercial farming in both temperate highveld and sub-tropical lowveld. The available infrastructure including several state buildings and enterprises will also be handed over to the Boers.

The Boers will operate their new farms as part of their business undertakings in South Africa, dispatching White Afrikaner managers and supervisors to Mozambique. The Boers will bring from South Africa their Black right-hand men, their tractor operators, their technicians. In the words of the project liaison officer at the South African High Commission in Maputo: “Each and every Afrikaner farmer will bring his tame Kaffirs” who will be used to supervise the local workers. The number of White settlers in the concessionary areas in Niassa is likely to be small.

SACADA has carefully mapped out the designated areas by helicopter, South Africa’s agricultural research institutes have surveyed the area, providing an assessment of environmental as well as social and demographic conditions.

Creating “rural townships”

Under the SACADA scheme, the rural communities in Niassa which occupy the Afrikaner concessionary areas are to be regrouped into “rural townships” similar to those of the Apartheid regime:

“What you do is to develop villages along the roadside close to the [White] farms. These villages have been planned very carefully [by SACADA] in proximity to the fields so that farm-workers can go back and forth; you give the villages some infrastructure and a plot of land for each household so that the farm-labourers can set up their food gardens.”

Unless token customary land rights are entrenched within or in areas contiguous to the concessions, the peasants will become landless farm labourers or “labour tenants.” Under the latter system applied by the Boers in South Africa since the 19th Century, black peasant households perform labour services (corvée) in exchange for the right to farm a small parcel of land. Formally outlawed in South Africa in 1960 by the Nationalist government, “labour tenancy” remains in existence in many parts of South Africa including East Transvaal and Kwa-Zulu Natal. Its reproduction in the form of rural townships in Mozambique will provide reserves of cheap labour for the White commercial farms.

This, plus the increasing derogation of workers rights in Mozambique and the deregulation of the labour market there under IMF advice, will enable the Boers not only to pay their Mozambican workers excessively low wages but also to escape the demands of Black agricultural workers in South Africa. Moreover, under the Mosagrius Agreement the Mozambican government will be fully responsible in dealing with land disputes and ensuring the expropriation of peasant lands “without prejudice or loss that may occur from such claims to SDM [Mosagrius] and other Mosagrius participants.”

Small wonder, then, that South Africa’s major commercial banks, the World Bank and the European Union have firmly backed the project. Indeed, “the Food Corridor” has become an integral part of the IMF-World Bank sponsored structural adjustment programme in Mozambique. In the words of SACADA Secretary Willie Jordaan: “SACADA has endeavoured to bring its policies in line with the World Bank and the International Monetary Fund, and [is]set to become an international development agency” with a mandate to contract with donor institutions and carry out “foreign aid programmes” on their behalf.

The international community

In short, while the international community had endorsed ANC’s struggle against the Apartheid regime, it is now providing financial support to a racist Afrikaner development organization. Under the disguise of “foreign aid,” Western donors are in fact contributing to the extension of the Apartheid system into neighbouring countries. The European Union has provided money to SACADA out of a development package explicitly earmarked by Brussels for South Africa’s Reconstruction and Development Programme. According to an EU spokesman, the project “was the best noise out of Africa in 30 years.” The EU Ambassador to South Africa Mr. Erwan Fouéré met General Viljoen to discuss the project. Fouéré confirmed that if all goes well, further EU money could be made available to cover the costs of “settling Afrikaner farmers in South Africa’s neighbouring countries.”

The initiative is categorized by the donor community as a bona fide development project which will benefit the peasantry in the host country as well contribute to South Africa’s Reconstruction. The fact that the scheme derogates the land rights of small-holders and replicates the system of “labour tenancy” prevalent in South Africa under Apartheid is not a matter for discussion.

Moreover, national investment priorities set by the donors in neighbouring countries (under the World Bank sponsored Public Investment Programme), are increasingly tuned to meeting the needs of South African business interests. In Mozambique, for instance, so-called “targeted investments” are undertaken with a view to rehabilitating port facilities, roads, water resources, river and lake transportation, etc. largely to the benefit of South African investors including SACADA.

Moreover, under the SACADA Agreement, Afrikaner investors “shall be allowed a right of first refusal” in privatization tenders in concessionary areas under their jurisdiction. In turn the country’s investment legislation (drafted with the technical assistance of the World Bank) will provide for the free remittance of corporate profits and the repatriation of capital back to South Africa.

The SACADA scheme is also likely to suck up a portion of the State’s meagre health and education budget. In Mozambique, under the terms of the Agreement the authorities are also to support the provision of Western-style health services as well as create a “sanitary environment” for the White Afrikaners settling in the territory. Part of the money provided by donors and international organizations for social programmes will also be channelled towards the concessionary areas.

Recolonization?

Add to these enormities the fact that the “export of Apartheid” to neighbouring countries seems to exemplify a literal “carving up” of national territories into concessionary areas. In Mozambique, for example, an autonomous territory – “a State within a State” – is being developed initially in Niassa province; the Mosagrius project controlled by the Boers (overriding the national and provincial governments) is the sole authority concerning the utilization rights of land in its concessionary areas (clause 34); similarly the territory is defined as a free trade zone allowing for the unimpeded movement of goods, capital and people (meaning White South Africans). All investments in the concessionary areas “will be free from customs duties, or other fiscal impositions.” In this way, concessions granted to foreign investors in various parts of the country (a pattern that is being duplicated [see accompanying box] in the tourism sphere, including in Niassa Province itself) begin to define a recasting of national territory into a number of separate “corridors” that is eerily reminiscent of the colonial period.

In short, the system of territorial concessions – with each of the corridors integrated separately into the world market – tends to favours the demise of the national economy. And the falling of such corridors under the political custody of donors, non-governmental organizations and foreign investors also means that these latter constitute a de facto “parallel government” which increasingly bypasses the State system. But this latter process dovetails neatly with other demands of donors, their requirement (in the name of “governance”) of the down-sizing of the central State and the “decentralization” of decision-making to the provincial and district levels. Rather than providing added powers and resources to regional and local communities, however, State revenues will be channelled towards servicing Mozambique’s external debt with “decentralization” predicated on fiscal austerity under the structural adjustment programme. Add all this up and the result is a considerable weakening of both the central and regional governments, and a further reinforcement of Mozambique’s recolonization.

One may speculate, finally, as to why the ANC has made itself such a vigorous party to this process. Most charitably, one may conclude that the ANC has championed – albeit without serious debate or discussion – the granting of “Land to the Boers” in neighbouring countries as a means to relieving land pressures within South Africa: the policy is said to facilitate the ANC’s land redistribution programme in favour of Black farmers.

Of course, there are good reasons to believe that, despite its merits, South Africa’s Land Reform Programme is unlikely to succeed, this programme being increasingly undermined by the post-Apartheid government’s own sweeping macro-economic reforms under the neoliberal policy agenda. In rural South Africa, the removal of agricultural subsidies, the deregulation of credit and trade liberalization (which is part of the Macro-economic Framework) have not only contributed to the further impoverishment of Black small-holders and tenant farmers, the measures have also pushed numerous White Afrikaner family farms into bankruptcy. Pretoria’s structural adjustment programme thereby favours an even greater concentration of farmland than during the Apartheid regime as well as the consolidation of corporate agriculture both within and beyond South Africa’s borders.

In other words, the Boers “Second Great Trek” to neighbouring countries does not contribute to relieving land pressures within South Africa. In fact the policy accomplishes exactly the opposite results: it maintains Black farmers in marginal lands under the old system of segregation. Moreover, it reinforces corporate control over the best farmland while also providing a political avenue to Afrikaner agri-business for “exporting Apartheid” to the entire Southern African region.

Note

Most of Mozambique’s coastline on lake Niassa – including a 160 km. stretch in the Rift Valley from Meponda to Mapangula extending further North to Ilha sobre o Lago close to the Tanzanian border – has been designated under the project “for tourism and other complementary and subsidiary activities [which are] ecologically sustainable.” The latter also include designated areas for Afrikaner investments in fishing and aquaculture on lake Niassa (displacing the local fishing industry). In turn, the Agreement hands over to the Boers, the development and operation rights over the Niassa Game Reserve on the Tanzanian border. The Reserve includes an extensive area of some 20,000 hectares earmarked for so-called “ecologically sustainable ecotourism.”

In a much larger undertaking, James Ulysses Blanchard III the notorious Texan tycoon, has been granted a concession over a vast territory which includes the Maputo Elephant Reserve and the adjoining Machangula peninsula south of Maputo. During the Mozambican civil war, Blanchard had provided financial backing to Renamo, the rebel organization directly supported by the Apartheid regime and trained by the South African Defence Force (SADF).

Blanchard intends to create an Indian Ocean Dream Park with a floating hotel, deluxe tourist lodges at $600 – $800 a night and a casino. Large parcels of land in Manchangula have also been allocated to agricultural investors from Eastern Transvaal.

Local communities in Blanchard’s concessionary area will be expropriated; in the words of his general manager, John Perrot:

“We’re gonna come here and say [to the local villagers] `Okay, now you’re in a national park. Your village can either get fenced or you can have them wild animals walking right through your main street’.” (M.C.)

UN Says Agenda 21 and African Land Grabs will Save the Forests

“Land grabs were said to be the causation of the 2007-08 world food price crisis; as countries like oil-rich Saudi Arabia and South Korea bought or leased massive tracts of land in Africa, Asia and Latin America.”

The blizzard, which has been named Alexa,  forced Jerusalem into lockdown today after more than 50cm of snow was dumped on  the region.

The unusual weather system brought travel  chaos and disruption to much of the region.

People had to abandon their cars and seek  emergency shelter as the snowstorm  brought transport to a standstill.

Police set up roadblocks on routes in and out  of the ancient city.

Ben Gurion airport near Tel Aviv was  shut  earlier this morning and Egypt’s main ports on the Mediterranean  and the Red  Sea remained closed for the third straight day due to bad  weather.

Israelis were told over media and  public  broadcasts today not to enter or leave Jerusalem and some 1,500  people were  evacuated from stranded vehicles overnight, said police  spokesman Micky  Rosenfeld.

Three  emergency centers were set up and  medics treated 350 people for cold-related  symptoms, Rosenfeld said.  Jerusalem Mayor Nir Barkat said he asked the military  for assistance.

Rare snow also fell in Cairo’s suburbs, the  port city of Alexandria and a blanket of white covered St. Catherine’s Monastery  on Mt. Sinai.

The cold weather was part of a storm,  dubbed  Alexa, which has been pounding much of Lebanon and parts of  northern Syria  since Wednesday, pushing temperatures below zero and  dumping snow and heavy  rains.

The snow has heaped another layer of misery  on the already grim existence  of many of the more than two million Syrians who  have fled the civil war raging in their homeland.

TWENTY inches of snow brings the Holy Land to a  standstill

The weather even featured in talks between  visiting U.S. Secretary of State John Kerry and Prime Minister Benjamin  Netanyahu, who said he was briefed on the emergency measures.

Kerry, a former Massachusetts senator, said  the snow made him feel ‘at home’.

‘I have heard of making guests welcome  and  feeling at home. This is about as far as I’ve ever seen anything  go… giving  me a New England snowstorm,’ Kerry said as he viewed a  snow-covered Old City of  Jerusalem with Netanyahu.

In the West Bank and Gaza, U.N. relief teams  offered emergency services to the worst-hit communities.

In Gaza, which was experiencing its first  snow in a decade, more than 500 people were evacuated from their homes,  according to Hamas spokesman Ihab Ghussein.

Egypt’s state MENA news agency said the  country’s two Mediterranean ports near the city of Alexandria and two ports on  the Red Sea remained closed for the third day Friday.

The report quoted the head of the Alexandria  port authority, Adel Yassin Hammad, as saying the decision was taken to avoid  possible accidents in the ports.

A three-month investigation shows that some of the most outspoken campaigners who demand that consumers pay the colossal price of shifting to renewable energy are also getting rich from their efforts.

Enquiries by this newspaper have revealed: 

  • Four of the nine-person Climate Change Committee, the official watchdog that dictates green energy policy, are, or were until very recently, being paid by firms that benefit from committee decisions.
  •   A new breed of lucrative green investment funds, which were set up to expand windfarm energy, are in practice a means of taking green levies paid by hard-pressed consumers and handing them to City investors and financiers.
  • £3.8 billion of taxpayers’ money funds the new Green Investment Bank, set up by the Department of Business and Skills. One of its biggest deals involved energy giant SSE selling windfarms to one of the new green funds, Greencoat Wind. The Green Investment Bank’s chairman, Lord Smith of Kelvin, is also chairman of SSE. The bank says it ‘provided expertise’ to enable BIS to take a £50 million stake in Greencoat, which helped fund the SSE sale.
  • The same bank’s chief executive, Shaun Kingsbury, is one of the UK’s highest-paid public sector employees. His £325,000 salary is more than twice the Prime Minister’s.
  • Firms lobbying for renewables can virtually guarantee access to key Government policy-makers, because they are staffed by former very senior officials – a striking example of Whitehall’s ‘revolving door’.

Sheriffs Refuse to Enforce Gun Control Laws

New gun control laws are unconstitutional, say scores of sheriffs throughout the country, and they are either refusing to enforce the statutes or have signaled that enforcement will be a very low priority, The New York Times reports.

In Colorado, a law passed by the Legislature that requires universal background checks and bans ammunition magazines that hold more than 15 rounds is being challenged in a lawsuit by all but seven of the state’s 62 elected sheriffs who say it’s a violation of Second Amendment rights.

New laws in other states which were brought about as a result of the Newtown, Conn. school shootings, are also facing resistance, the Times reported Sunday.

In New York, two sheriffs have said publicly they would not enforce new gun  laws, some of the toughest in the nation.  In California, a delegation of  sheriffs tried to convince Gov. Jerry Brown to veto gun bills that would ban  semiautomatic rifles with detachable magazines and lead ammunition for hunting,  according to the Times.

“All law enforcement agencies consider the  community standards — what is it that our community wishes us to focus on — and  I can tell you our community is not worried one whit about background checks or  high-capacity magazines,” Sheriff W. Pete Palmer of Chaffee County, Colo., told  the Times.

Nevertheless, in Colorado, officials argue the laws are  already having an effect.  They point to figures that show, of the 3,445  background checks on private gun sales since the law went into effect on July 1,  70 people were denied weapons.

“Particularly on background checks, the  numbers show the law is working,” Eric Brown, a spokesman for Colorado Gov. John  Hickenlooper, told the Times.

Police chiefs in the state, particularly in  urban areas, agree that the new laws are making an impact, saying most gun  stores have stopped selling high-capacity magazines for personal use, though  some continue to do so illegally.

Law enforcement officials, however,  acknowledge that sheriffs have wide discretion in enforcing state laws.  And  while sheriffs could be removed for refusing to enforce state statutes, one  expert suggests that many governors could be reluctant to use such powers.

“In my oath it says I’ll uphold the U.S. Constitution and the Constitution  of the State of Colorado,” Sheriff John Cooke of Weld County told the Times.   “It doesn’t say I have to uphold every law passed by the Legislature.”

I must have missed where the Governor can arbitrarily or otherwise remove the highest ELECTED Law Enforcement Official in a county.  And who is this socalled “expert” who doesn’t know what he’s talking about?! The Sheriffs DO NOT serve “at the pleasure of the Governor” but the Constitution which they swore to uphold – as did the governor for that matter which he’s now violating. This governor and others are targeting innocent citizens thus making them criminals and what’s more it’s none of their business!

Greenpeace Uses Depressed Santa to Claim ‘North Pole is Melting’

Arctic ice has actually increased 29 per cent since last summer

Greenpeace is running ads in major transportation hubs around the world featuring an image of a depressed Santa Claus alongside the words, “The North Pole is melting. You’d better believe it.”

The photo above, taken at a London underground station, encourages people to donate £3 to the charity, “To help save the Arctic and get a message from Santa.” [mediachecker->he looks like a disheveled Castro the morning after..]

However, just like Father Christmas, the claim that the North Pole is melting is a complete myth.

From summer 2012 to summer 2013, the Arctic ice sheet increased by an area of 533,000 square miles, a rise of 29 per cent.

NASA imagery released earlier this year illustrated how, at the height of summer, an ice sheet more than half the size of Europe stretched from Canada to Russia.

This followed claims by scientists back in 2007, reported by the BBC, that the Arctic would be “ice free” by the summer of 2013.

The slogan, “The North Pole is melting. You’d better believe it,” seems almost like a threat. Enforced belief in such a premise is apparently necessary because the actual facts suggest the opposite is true.

This is yet another example of how the global warming alarmist camp is forced to rely on propaganda designed to manipulate people on an emotional level, where contrived perception takes precedence over reality.

As empirical scientific evidence increasingly confirms that man-made CO2 emissions do not cause any significant global warming and in fact that the Earth is currently in one of its most environmentally stable phases for centuries, the desperation of the climate change industry will continue to reveal itself in increasingly bizarre ways.

The claim that the North Pole is melting holds about as much weight as ManBearPig Al Gore’s implication that polar bears are drowning because of global warming.

Boston Bomber Believed He Was a Victim of Mind Control

Suspected Boston marathon bomber Tamerlan Tsarnaev believed that he was a victim of mind control, according to the results of a five month investigation published yesterday by the Boston Globe.

Tsarnaev, who was killed in a shootout with police four days after allegedly carrying out the bombings with his brother Dzhokhar Tsarnaev, was thought to have “some form of schizophrenia,” according to family friends, while his mother said Tsarnaev “felt like there were two people living inside of him.”

“He believed in majestic mind control, which is a way of breaking down a person and creating an alternative personality with which they must coexist,” Donald Larking, a 67-year-old who attended a Boston mosque with Tamerlan, told the Globe. “You can give a signal, a phrase or a gesture, and bring out the alternate personality and make them do things. Tamerlan thought someone might have done that to him.”

The link between allegations of mind control and violent acts such as political assassinations or terror attacks has been a running theme in numerous different high profile cases.

Aurora theater gunman James Holmes said he was “programmed” to carry out the massacre by an “evil” therapist, according to an alleged inmate of the ‘Batman’ shooter. Steven Unruh claims that Holmes told him he “felt like he was in a video game” during the shooting and that he had been brainwashed with the aid of neuro-linguistic programming.

The parallels between James Holmes and another alleged victim of mind control – RFK assassin Sirhan Sirhan – are astounding.

As the London Independent reported in 2005, evidence strongly indicates that Sirhan was a Manchurian candidate, a victim of mind control who was set up to be the fall guy for the murder. Sirhan was described by eyewitnesses as being in a trance-like state as he pulled the trigger.

“There was no way Sirhan Sirhan killed Kennedy,” said (Sirhan’s lawyer Larry) Teeter….He was the fall guy. His job was to get busted while the trigger man walked out. He wasn’t consciously involved in any plot. He was a patsy. He was unconscious and unaware of what was happening – he was the true Manchurian Candidate.”

The CIA’s use of mind control to create killers is a matter of historical record. MK-ULTRA was the code name for a covert, illegal CIA human research program, run by the Office of Scientific Intelligence that came to light in 1975 through investigations by the Church Committee, and the Rockefeller Commission. 14-year CIA veteran Victor Marchetti insists that the program is ongoing and has not been abandoned.

According to his lawyers, Sirhan Sirhan “was an involuntary participant in the crimes being committed because he was subjected to sophisticated hypno programming and memory implantation techniques which rendered him unable to consciously control his thoughts and actions at the time the crimes were being committed,” and served only as a diversion for the real assassin.

Jared Lee Loughner, the gunman who shot Congresswoman Gabrielle Giffords and killed six other people, was also obsessed with mind control.

Were the Tsarnaev brothers set up or brainwashed into carrying out the Boston marathon bombing? It’s a claim that would be virtually impossible to prove, but it would explain a number of extraordinary contradictions pertaining to the case, including why the brothers apparently shouted “we didn’t do it” during their shootout with police.

The aunt of Tamerlan Tsarnaev claims that the footage which emerged of police arresting a naked uninjured man was her nephew, contradicting the official narrative that Tsarnaev was critically injured in a shootout and suggesting he may have been killed while in custody.

According to Tamerlan’s mother Zubeidat Tsarnaeva, the the FBI “were controlling his every step.” It was subsequently confirmed that both the FBI and the CIA added the brothers to at least two terrorist watch lists in late 2011.

Yemeni parliament votes to ban drone attacks

An anti-drone motion was passed by Yemen’s parliament on Sunday, banning drone attacks. The symbolic vote comes amid growing anger against US unmanned aircrafts used to kill off Al-Qaeda-linked terrorists. Concerns for civilians are also on the rise.

“Members of parliament voted to stop what drones are doing in Yemeni airspace, stressing the importance of preserving innocent civilian lives against any attack and maintaining Yemeni sovereignty,” SABA news agency reported.

The non-binding motion needs to be approved by the president in order to have any political weight. At the moment, the motions passed by the Yemeni parliament are seen as no more than recommendations to the government, Reuters stressed.

Washington has recently increased the intensity of drone strikes in Yemen in an offensive against Al-Qaeda in the Arabian Peninsula (AQAP), despite widespread criticism sparked by the fact that strikes are far from “surgical.”

Yemen is considered to be AQAP’s main foothold of what is deemed the most active wing of the militant network.

The success of the US campaign remains a very heated topic of debate. Some argue that the drone strikes put civilian lives in danger, leading to rising casualties, while at the same time increasing sympathy towards AQAP and fostering resentment against the US.

Others feel that the US campaign is needed to eliminate Al-Qaeda. Yemeni Foreign Minister Abu Bakr al-Qirbi told Reuters in September that the drone strikes were a “necessary evil” and a “very limited affair,” that occur only with Yemeni consultation.

The new law comes after 15 people were killed in a Thursday air strike while on their way to a wedding. Local media reported that a drone attack was responsible, stating that the party-goers were hit instead of an Al-Qaeda convoy.

“An air strike missed its target and hit a wedding car convoy, ten people were killed immediately and another five who were injured died after being admitted to the hospital,” a Yemeni security official told Reuters.

In October, Human Rights Watch (HRW) released a damning report on US drone strikes in Yemen. It described six of some 80 targeted killing operations in the country. In those six attacks, 82 people were killed, 57 of whom – nearly 70 percent – were civilians.

“President Obama says the US is doing its utmost to protect civilians from harm in these strikes. Yet in the six cases we examined, at least two were a clear violation of the laws of war,” HRW senior researcher Letta Tayler commented at the time.

In the same month, UN special rapporteur on human rights and counterterrorism, Ben Emmerson, said that US drone strikes had killed 2,200 people in Pakistan in the past decade – 400 of whom were civilians and another 200 who were “probable non-combatants.” Much like Yemen, many within Pakistan’s population vehemently oppose American drone strikes.

Millennials Finally Turn Against Obama, Want Recall

A new poll from Harvard University’s Institute of Politics found that Millennial approval of Obama has dipped to the lowest ever, at 41 percent. Their dissatisfaction with Obama now mirrors the rest of the country. Similarly, 56 percent of Americans aged 18 to 29 disapprove of Obamacare, compared to only 39 percent who support it. The younger Millennials are becoming increasingly less Democratic. Of those age 18 to 24, 31 percent identify as Democrats and 25 percent as Republicans.

This is occurring in part because the entry level jobs they are qualified for are drying up and turning into free internships. Paid internships are becoming a rarity. Millennials are realizing the Occupy Wall Street movement’s demands only succeeded in making things worse for them. Fast food workers striking for higher wages is hurting, not helping them. Instead of having a good shot at what used to be plentiful fast-food jobs, young people are finding themselves replaced by fast-food ordering kiosks.

Retail jobs aren’t faring much better. Instead of a fairly set, dependable schedule, young people are discovering they need to compete for hours each week in a bidding system online. There are fewer customer service jobs available than there were 20 years ago, because so many corporations have outsourced those positions to countries like India in order to avoid punishing labor laws forced upon them within the U.S. by unions. Jobs with 40 hours a week and benefits are becoming harder to find, as employers increasingly rely upon part-time workers in order to avoid providing health insurance with its onerous, unaffordable requirements under Obamacare.

The cost of higher education continues to escalate, with no end in sight. College students are graduating with over $100,000 in student loans, yet are lucky if they can find a full-time minimum wage job upon graduating.

Finally, the reality of Obamacare is setting in. Young people thought they would have free health insurance. In reality, the true cost of healthcare through the Obamacare exchanges is coming out and it is much more than what they would pay for in the private sector. Instead of paying $4/mth for birth control at Walmart through the private sector, Sandra Fluke has ensured that government intervention in the area of birth control will escalate everyone’s overall healthcare premiums and costs.

Obamacare is designed so that young, healthy people pay more for healthcare in order to subsidize older, less healthy people. The fewer young people who enroll, the higher the costs of Obamacare. Obamacare needs 40 percent of those who sign up to be under 35, but only 29 percent of uninsured 18-to-29-year-olds say they intend to enroll.

The older generations are better suited to buy into Obama’s false promises of hope and change, because there is still a little money left to be borrowed to pass along to them through Social Security, and they have seniority at their existing union jobs. Millennials aren’t benefiting from any of this. The best they get from this administration is staying on their parents’ health insurance a few extra years – embarrassing at best.

As young people continue to struggle five years into Obama’s presidency, they are becoming resentful of his endless pricey jaunts around the world with his wife and daughters, visiting the most exotic locations and meeting celebrities galore. While Michelle Obama wears the finest designer clothing, Millennials are still living in their parents’ basements well into their 20’s, lucky to even own a used car.

Another factor contributing to Millennial dissatisfaction is the vast domestic surveillance state imposed by this administration. What was once considered a Republican area – national security – has now been taken to new lengths by the left under Obama. Millennials are wired more than previous generations, so spying on their wireless phones, email and social media activity disproportionately affects them. It is no coincidence that the individual who leaked information about the NSA’s domestic surveillance program, Edward Snowden, Is only 30.

In 2008, 66 percent of young people voted for Obama, which decreased to 60 percent in 2012. Without the youth vote, Obama would not have won reelection. This bodes well for Republicans in 2016. The Democrats have no money left to promise young people.

What has Obama done for young people? Government-controlled birth control which increased their healthcare costs, and some tinkering with student loans, which has had no more effect on rising education debt than throwing a thimbleful of water on a fire. Millennials are stuck paying for broke entitlement programs the Democrats promised to older generations in order to buy the latter’s vote. The party is over, and young people are tired of picking up the tab.

Why, because someone sold 2 million ounces of gold at one time. Who does this? Who sells nearly 2 and half percent of annual gold production in a single minute? The gold valued at over $2.5 billion could not have been sold by a small trader, and certainly not the smart money, institutional investors know that you don’t exit a large trade like this…

So who could it be? Try the dumb money, The Western Central Banks.

With the western central banks suppressing the price, the eastern central banks have been happy buyers.

However, PeakResources.org believes this gold price suppression scheme is nearing its end.

With the Federal Reserve on a fiat currency suicide mission with QE forever, and the U.S. federal government bankrupt, the days of dollar supremacy are in its last days.

For gold though, the central banks have really screwed themselves.

At a price of $1,250, gold mining companies can no longer make a profit. Recent studies show their all in cash cost anywhere from $1,400 to as high as $1,700. Liquid fuels, human energy, and new exploration are costly in the mining process, so it is unlikely these costs can be cut to accommodate the low gold price.

Since gold’s peak in 2011, the TSX Venture exchange, home to the worlds gold exploration companies, is down more than 59%

The gold juniors index, the GDXJ, is down 83%

And the large cap gold companies, despite seeing a 400% increase in the price of gold over the past 12 years, are trading at lower valuations then they did even 20 years ago.

As noted in our video Peak Gold, no major gold discoveries have been found in more than 10 years! Gold production as a whole has plateaued.

Remember, all mines have a limited supply of gold, at some point in time they either deplete themselves or become uneconomical. Uneconomical meaning companies can’t mine for profit, which is exactly the case for nearly all gold mines today!

Consider a very famous gold mining region, South Africa

In 1971 South Africa produced 47.5 million ounces of gold, accounting for 68% of global mine production.

In 2011, South Africa accounted for only 7% of gold production with about 8 million ounces of mine production.

Despite all the technological advances and billions in exploration and development, South African gold production is down 82%.

South Africa isn’t an anomaly either, here in the U.S. production in the past 20 years is down 30%.

Current discoveries are small, in remote areas, and are lower grade deposits.

What this all leads to is a price spike in gold, just as gold rose rose from $35 to $850 in the 70s, The Dow Jones from 2,000 to 11,000 in the 1990, and Bitcoin from a penny to $1,200 more recently, so to can gold have a parabolic spike.

A French court will begin hearing arguments Wednesday in a case that will challenge the country’s ban on wearing full-face veils in public, with lawyers arguing that the 2011 veil ban is discriminatory and unconstitutional.

A French court will begin hearing arguments Wednesday in a case that will challenge the legality of the country’s ban on wearing full-face veils.

A lawyer for Cassandra Belin, who was arrested in July for wearing the veil, will contend that the 2011 law banning the veil is discriminatory and unconstitutional when he appears before the Versailles court just outside Paris.

“She does not want to be wrongly perceived as the symbol of a supposed rampant Islamisation,” lawyer Philippe Bataille said of his client, who will not be present at Wednesday’s hearing.

Belin, 20, who converted to Islam five years ago, was stopped by police in the town of Trappes west of Paris on July 18, during the Ramadan fasting month, for wearing the veil.

An altercation ensued and her husband, Michael Khiri, was accused of insulting a police officer and arrested. He was later found guilty and received a three-month suspended sentence.

His sentencing sparked riots in Trappes, which has a large immigrant population. Hundreds of protesters torched cars, destroyed bus stops and hurled stones at police in two nights of violence.

Belin went on trial in October for defying the ban and insulting a police officer, but her lawyer launched a constitutional challenge to the charges and the Versailles court agreed to consider arguments that the law is unconstitutional.

Bataille says the ban infringes on freedom of religion, freedom of movement and goes against human dignity.  He also says that routine identity checks were being misused by some police officers to harrass veiled women.

‘Testing France’s institutions’

The controversial ban on face coverings was introduced in 2011 on the grounds that garments concealing a person’s identity can pose a security threat.

All full-face coverings, including ski masks, are banned under the law. But many believe the legislation in fact seeks to target the Islamic veil, with some arguing that motorcycle helmets also cover the face.

Belin has admitted to telling the police officers to “shut up” but denied saying, “Allah will exterminate you” as has been claimed.

The police officers’ lawyer, Thibault de Montbrial, has said that the case against his clients involves a “small group of radical elements” that is “testing the institutions” of France – which is officially secular – under the guise of religious freedom.

In a parallel case, one of the three officers involved in the Belin incident is being investigated for using Islamophobic language on Facebook and for “inciting hatred and racial discrimination”, which is against the law in France.

Canada split over hijab-style Muslim police uniform

City authorities in Edmonton, Alberta, have unveiled a new hijab-style headscarf as part of its police uniform for Muslim women officers. Not all Canadian provinces, notably French-speaking Quebec, want to follow suit.

Police in Edmonton, Alberta, Canada, this weekend unveiled official hijab-style headscarves approved for use by female Muslim officers, in a move that has revealed a growing split in attitudes towards the wearing of religious symbols across the country.

The Edmonton Police Service (EPS) said in a press release that the the hijab-style headscarf, which covers the hair and neck but not the face, was designed to “reflect the changing diversity in the community, and to facilitate the growing interest in policing careers from Edmonton’s Muslim community”.

Edmonton city councillor Scott McKeen said the move was a “gesture of inclusion” towards the Muslim community.

“One of the perceptions about Edmonton and Alberta is that we’re kind of redneck,” he told reporters, adding that the decision to allow headscarves was “sort of saying that we want to have a diverse police service that reflects the diversity and multicultural aspects of Edmonton.”

Alberta Canada’s third biggest Muslim community (some 45,000 Muslims in a total population of 700,000), followed by Ontario, which has allowed women police officers to wear hijabs since 2011, and then Quebec.

Ontario capital Toronto is looking to extend the freedom to wear religious symbols to other areas of the public service and there is also a campaign to make hijabs permitted in hospitals (see below).


But the attitude in Alberta and Ontario towards their Muslim populations is not shared by all its fellow Canadian provinces.

Notably, French-speaking Quebec is following fiercely secular France’s lead, and its National Assembly is poised to pass its “Quebec Charter of Values”.

The charter, part of a bill proposed earlier year by the nationalist Parti Quebéquois which dominates the assembly, would prohibit public employees at government offices, schools, hospitals, courts and police stations from wearing any religious symbols, including Muslim hijabs, Sikh turbans, Jewish kippas and visible crucifixes. The move has seen widespread opposition from the province’s Muslim minority, with two protest marches against the proposed law in Montreal in recent months.

American ‘girl next door’ wows Lebanese ‘X Factor’– Arabs Got Talent

Despite speaking little Arabic, Jennifer Grout, a 23-year-old singer from Boston, Massachusetts, has amazed viewers and judges of the Lebanese talent show Arabs Got Talent, making it to the final round. She tells FRANCE 24 about her experience.

Jennifer Grout, a 23-year-old singer from Boston, Massachusetts, looks like the stereotypical girl next door. Yet she is anything but. Despite speaking little Arabic, she has amazed viewers and judges of the Lebanese talent show Arabs Got Talent, making it to the final round of the competition.

Raised in a musical family, Grout grew up playing the violin and the piano as well as singing in a choir. She first began to pursue her passion for Arabic music in 2010 while at Canada’s McGill University, in Montreal. She begged her parents to buy her an oud (a lute-like instrument), and set about learning how to play and sing Arabic songs.

A few months later, Grout stumbled across a Syrian restaurant in her neighbourhood where an oud player was performing live. Enchanted, she went in to listen. Before long, the musician asked her if she knew how to play.

“I took the oud and started playing and singing an old muwashshah [an Arabic poetic genre] I’d heard on YouTube by a singer called Souad Mohammed.  When I was finished, everyone was stunned!  The owner came and gave me a kiss on my forehead and asked me if I’d been sent from heaven!” Grout told FRANCE 24.

She began performing at the restaurant on a weekly basis. “I was so happy because I felt like I’d finally found a community that appreciated my work,” she said.

Arabs Got Talent

After university she packed her bags and headed to Morocco. From there, she went to Spain and then to France where she sang for money in the Paris metro (“I saw people doing it, so I figured why can’t I?” she explained). She then travelled to Austria, before finally landing back in Morocco, where she has more or less settled since.

Grout got the idea to sign up for Arabs Got Talent earlier this year after a friend sent her an application form, urging her to fill it out.

“I honestly knew nothing about it, other than it must be similar to America’s Got Talent, which I didn’t ever contemplate applying to because I don’t think my talent would have been appreciated or understood as much,” she said.

Her first appearance on the show, which is in its third season, was somewhat daunting. Already unsure how her performance would be received by the judges and public, she also quickly realised that her inability to speak Arabic could be a problem.

“I just thought, ‘Oh my God, I don’t understand what they are saying, their comments and feedback!’ So I simply smiled and nodded,” Grout said. “But then the hosts came on stage with me and translated.”

The competition’s judges were enthralled by her performance of beloved Egyptian singer Umm Kulthum’s “Baïd Annak” and voted unanimously to send her to the next round.

 Grout’s mastery of the Arabic accent in song has led some to question whether her all-American appearance is just an act. Viewers quickly took to social media to express their disbelief over her background.

“I have absolutely no Arabic roots or ‘interesting’ Turkish ethnicities as I am rumoured to have,” she said. “I started learning Arabic music in 2010.  You can ask any of my family members, old friends, etc… Before that point, I knew virtually nothing of the Arab world, except that Arabs invented couscous and belly dancing.”

Since rising to fame on the show, Grout has at times been portrayed as a bridge between the US and Arabic cultures. While she was adamant that she plays for her own personal fulfillment, she also welcomed the idea that music could help break down barriers.

“Over time, of course, I have seen what a simple passion has the power to do. It can open their minds!  I find that idea really beautiful, and if people see me as a symbol of peace, I am more than honored to accept the role,” she said.

The final round of Arabs Got Talent is due to take place in Lebanon’s capital Beirut on December 7. Grout, who was careful to praise the other competitors on the show, said she thinks she’s got just as good a shot at winning as anybody.

“I’ll leave that up to the people to decide. Regardless of the results, it has been a wonderful journey, a great opportunity and I have had much fun and exposure throughout,” she said.

Jennifer Grout has a pure and mature voice for her age, the lyrics, music, and singing combined made it an awesome performance, but imho, English with an American accent isn’t her first language (and definitely not a Boston accent) since her foreign accent is so pronounced and she’s too young to have developed a first language accent from another country. She speaks French fluently so perhaps that’s got something to do with it though yours truly speaks a couple of languages which didn’t alter my first language accent nor does it affect the vast majority of those who do. Anyway she did extremely well to reach the top 3 - wish her well and hope to hear more from her in the future.

He defrauded the feds out of nearly $900,000 in salary and expense, including hundreds of thousands of dollars in first-class airfare and high-end hotels that more than doubled his per diem limit but were somehow approved by the EPA anyway. A Twitter pal calls it the worst case of Govtfluenza ever.

In September, [John] Beale, who served as a “senior policy adviser” in the agency’s Office of Air and Radiation, pled guilty to defrauding the U.S. government out of nearly $900,000 since 2000. Beale perpetrated his fraud largely by failing to show up at the EPA for months at a time, including one 18-month stretch starting in June 2011 when he did “absolutely no work,” as Kern, Beale’s lawyer, acknowledged in his court filing.

To explain his long absences, Beale told agency officials — including [EPA administrator Gina] McCarthy — that he was engaged in intelligence work for the CIA, either at agency headquarters or in Pakistan. At one point he claimed to be urgently needed in Pakistan because the Taliban was torturing his CIA replacement, according to Sullivan…

In fact, Beale had no relationship with the CIA at all. Sullivan, the EPA investigator, said he confirmed Beale didn’t even have a security clearance. He spent much of the time he was purportedly working for the CIA at his Northern Virginia home riding bikes, doing housework and reading books, or at a vacation house on Cape Cod

Nor was that Beale’s only deception, according to court documents. In 2008, Beale didn’t show up at the EPA for six months, telling his boss that he was part of a special multi-agency election-year project relating to “candidate security.” He billed the government $57,000 for five trips to California that were made purely “for personal reasons,” his lawyer acknowledged. (His parents lived there.) He also claimed to be suffering from malaria that he got while serving in Vietnam. According to his lawyer’s filing, he didn’t have malaria and never served in Vietnam. He told the story to EPA officials so he could get special handicap parking at a garage near EPA headquarters.

Despite an internal investigation and looming prison sentence, some of Beale’s more slow-witted pals at the EPA — who are crafting America’s environmental policy as I write this — apparently still believe that he’s a spy and is simply choosing to “take one for the team” by accepting jail time in order to preserve the secrecy of CIA operations in the field. Don’t underestimate a fool’s willingness to protect his ego by willingly continuing to be fooled. And the punchline is, if Beale hadn’t pushed his greed to an even more absurd length, he’d probably have gotten away with it. He threw a big retirement party for himself aboard a yacht in September 2011; six months later, his boss discovered that he was still on the payroll and the resulting probe uncovered that … he wasn’t officially retired. He was still collecting checks. Apparently, for whatever reason, the guy decided to stop using his CIA nonsense as an excuse not to show up to work and just … fake-retired instead. If he’d quit while he was ahead and retired in 2011 for real, there never would have been an investigation. Although I guess you could look at it the opposite way too: If he’d only concocted a story that was closer to his field of expertise, he could have carried on forever. Had he told them he was hard at work perfecting the ultimate computer model of global warming at his secret home laboratory but that it just wasn’t ready for anyone to see it, they’d probably have given him a raise. As it is, some true-believing moron who worked with him at the EPA is going to end up visiting Langley some day and stenciling an extra star on the wall of honor, Carrie-Mathison-style.

I can’t lie: I feel a certain grudging admiration at the sheer balls it took to pull this off. Looking forward already to the 2016 Hollywood version in which Beale really is a CIA agent working for free under deep cover on Obama’s orders to save the planet from melting ice caps in the nick of time.

In a huge Environmental Protection Agency warehouse in Landover, enterprising workers made sure that they had all the comforts of home. They created personal rec rooms with televisions, radios, chairs and couches. On the walls were photos, calendars and pinups. For entertainment, they had books, magazines and videos. If they got hungry, they could grab something from a refrigerator and pop it into a microwave.

The crown jewel of their hideaway — which stored EPA office furnishings — was a 30-by-45-foot athletic center, cobbled together from “surplus” EPA gym equipment and decked out with a music system provided via “other agency inventory items,” according to a recently released inspector general’s report.

All of it was carefully hidden from security cameras by partitions and piles of boxes set up by the workers, employees of Apex Logistics, the contractor that ran the warehouse until the EPA severed ties after learning of the situation last month.

Syria’s War: The Next Phase

“Moderate” myth is dropped as West prepares to leverage terror threat to end war in their favor.

The alleged fleeing of General Selim Idriss of the so-called “Free Syrian Army” (FSA), was more symbolic than anything else. Whether or not he really fled, and whether he is in Turkey or Qatar is of little consequence. The so-called “moderates” he commanded were nothing more than a smokescreen, a cheap veneer applied to the hardcore Wahabist extremists of Al Qaeda’s Al Nusra franchise and similar fronts that have formed the core of foreign-backed militancy turned against the Syrian people from the very beginning of the conflict.

By threatening Syria’s allies with a prolonged Iraq-style terror threat, and the possibility of it being used as a springboard for operations elsewhere, it hopes to pressure the end of their support for the Syrian government and an end to the conflict favorable for Western interests. Instead, this new “terror threat” gives Syria’s allies a chance to more openly and extensively support Syria to combat what is truly a “war on terror.”

It was as early as 2007 when it was revealed that the US, Israel, and Saudi Arabia were planning on building up extremists within and around Syria for the purpose of eventually overthrowing the government. Pulitzer Prize-winning journalist Seymour Hersh warned about this in his extensive report titled, “The Redirection: Is the Administration’s new policy benefiting our enemies in the war on terrorism?” which prophetically stated (emphasis added):

“To undermine Iran, which is predominantly Shiite, the Bush Administration has decided, in effect, to reconfigure its priorities in the Middle East. In Lebanon, the Administration has coöperated with Saudi Arabia’s government, which is Sunni, in clandestine operations that are intended to weaken Hezbollah, the Shiite organization that is backed by Iran. The U.S. has also taken part in clandestine operations aimed at Iran and its ally Syria. A by-product of these activities has been the bolstering of Sunni extremist groups that espouse a militant vision of Islam and are hostile to America and sympathetic to Al Qaeda.”

While the initial conflict was disingenuously portrayed as the spontaneous militarization of unarmed protesters fighting against a “brutal regime,” in reality Al Nusra was already inside the country and operating on a national scale. 

The US State Department itself would reveal this in its December 2012 “Terrorist Designations of the al-Nusrah Front as an Alias for al-Qa’ida in Iraq,” which stated:

Since November 2011, al-Nusrah Front has claimed nearly 600 attacks – ranging from more than 40 suicide attacks to small arms and improvised explosive device operations – in major city centers including Damascus, Aleppo, Hamah, Dara, Homs, Idlib, and Dayr al-Zawr. During these attacks numerous innocent Syrians have been killed.

And while the West has attempted to portray these extremist groups as entities entirely separate from the “moderates” they have claimed to be openly training, funding, arming, and equipping to the tune of billions of dollars, there is no other logical explanation for Al Nusra’s ability to rise above these Western-backed “moderates,” unless of course they never existed and the West was, as was planned in 2007, simply arming Al Qaeda all along.

In Hersh’s 2007 report, it was noted that the West could not directly arm or fund the militant groups and that the US and Israel would have to funnel weapons and cash through nations like Saudi Arabia and Lebanon instead. Since 2011 when these plans went fully operational, Qatar and Turkey have also entered the fray. When questions are raised about Al Nusra’s rising prominence in the conflict, the West has been increasingly unsuccessful in convincing the world of its own plausible deniability.

As the Syrian government began early this year to decisively turn the tide against the West’s proxy invasion, and after several abortive attempts to directly intervene militarily, the West appears to have resigned the myth of “moderates” and as of this week, symbolically ended its so-called “non-lethal aid” to terrorists operating in Syria. In fact, the myth of “moderates” was perpetuated solely to justify intervening directly on their behalf. With direct intervention taken off the table, it appears a new phase in the war has begun.

 Indeed, the West has claimed it has stopped the flow of aid to its “moderate” proxies, however, in practice, billions of dollars of equipment, weapons, and other forms of support will continue to flow so long as there are forces of any kind fighting inside of Syria against the government and its people.

Geopolitical maneuvering reveals the framework for this next phase.

During the West’s disingenuous nuclear negotiations with Iran, a feigned rift was opened between the US and Saudi Arabia. In Reuters’ report titled, “Saudi Arabia warns of shift away from U.S. over Syria, Iran,” it stated:

Upset at President Barack Obama’s policies on Iran and Syria, members of Saudi Arabia’s ruling family are threatening a rift with the United States that could take the alliance between Washington and the kingdom to its lowest point in years.

Of course, Saudi Arabia owes its entire existence to the United States – from its oil infrastructure, its military, and even its brutal internal security forces – any real rift between the US and the Saudis would be a gust of wind upon a shaky house of cards.

In reality, the rift is nothing more than political cover for the West as Saudi Arabia plans a more open and aggressive proxy campaign against Syria. As it directly arms and builds up legions of Al Qaeda, this rift will afford the United States who will in fact still be assisting Saudi Arabia in its proxy war, a degree of plausible deniability.
In Foreign Policy’s article, “Why Is Saudi Arabia Buying 15,000 U.S. Anti-Tank Missiles for a War It Will Never Fight? Hint: Syria,” it states:

No one is expecting a tank invasion of Saudi Arabia anytime soon, but the kingdom just put in a huge order for U.S.-made anti-tank missiles that has Saudi-watchers scratching their heads and wondering whether the deal is related to Riyadh’s support for the Syrian rebels.

The proposed weapons deal, which the Pentagon notified Congress of in early December, would provide Riyadh with more than 15,000 Raytheon anti-tank missiles at a cost of over $1 billion.

Foreign Policy would go on to explain how the scheme would work, with the US replacing Saudi Arabia’s current arsenal while Saudi Arabia unloaded its older weapons onto terrorist armies invading Syria. FP reports:

But while the latest American anti-tank weapons might not be showing up in Aleppo anytime soon, that doesn’t mean the deal is totally disconnected from Saudi efforts to arm the Syrian rebels. What may be happening, analysts say, is that the Saudis are sending their stockpiles of anti-tank weapons bought from elsewhere to Syria and are purchasing U.S. missiles to replenish their own stockpiles. “I would speculate that with an order of this size, the Saudis were flushing their current stocks in the direction of the opposition and replacing them with new munitions,” said Charles Freeman, a former U.S. ambassador to Saudi Arabia.

Saudis’ Terror Legions Not Enough to Win War – West Has Another Plan Of course, with Syria’s army already decisively on the offensive, restoring order to large swaths of Syrian territory and with the West’s terrorist proxies in many cases surrounded and cut off completely by Syrian forces, simply increasing arms shipments will not make much of a difference – it will only prolong the inevitable and leave a lower intensity terror campaign like that seen currently in Iraq.

With the West dumping the “moderate” narrative and acknowledging that Al Qaeda is all that is left fighting in Syria, it is preparing to leverage that terror threat and the possibility of its ally Saudi Arabia enhancing that threat as leverage with the Russians to cut ties and support for the Syrian government and bring the conflict to an end favorable to the West which started it in the first place.
This was revealed in Foreign Policy’s article, “Obama Advisor: ‘Extremism’ Could Be Key to Ending Syrian Civil War,” which stated (emphasis added):

For the past two and a half years, as the civil war in Syria has descended into brutal bloodletting and spilled over its borders, Obama administration officials have consistently decried the growing presence of Islamist extremists in the conflict. But on Wednesday, Deputy National Security Advisor Antony Blinken turned that logic on its head: The growing role of extremist groups may actually be a good thing for bringing the conflict to a close, he said.

Speaking at Transformational Trends, a conference co-hosted by Foreign Policy and the Policy Planning Staff of the U.S. State Department, Blinken said that the radicalization of the conflict may create a shared interest among world powers to bring the war to an end. The growing prominence of radical groups has “begun to concentrate the minds of critical actors outside of Syria” and may strip the Bashar al-Assad regime of the key international backing that has so far helped to keep him in power.

If anything, however, such a move should be perceived by the world as the West conceding defeat and the resignation of its “global order” that once constituted hegemonic superiority. Syria’s allies should take this new designation of the conflict in Syria as a “terror threat” as an opportunity to expand open support for the Syrian government to carry out sweeping anti-terror operations. Russia, China, Iran, and all other nations of good will should go to the UN seeking binding resolutions to help the Syrian government fight what is admitted now even by the West as a “war on terror.”

The arrogance of the West may have just dealt the final blow to their global power and influence through this last attempt to leverage their own terror-front to end the conflict in their favor. Syria and its allies should take this opportunity to both expose the West and its regional axis of terror, and stop the war in Syria not with conditions favorable for the West and their regional ambitions, but with conditions favorable for the Syrian people.

UN’s Syria “Aid” Appeal is Bid to Relieve Trapped Terrorists

In August 2011, the Telegraph reported in an article titled, “Libya crisis: Rebel leaders hoping to starve Gaddafi stronghold of Sirte into submission,” that:

Rebel leaders hope to starve Colonel Gaddafi’s home town of Sirte into submission, laying siege to his last remaining stronghold in an attempt to avoid mass bloodshed, according to the man spearheading efforts for a peaceful takeover.

Assisting them in the starvation of the 100,000 civilians who populated the coastal city of Sirte was NATO who rained bombs down upon the besieged city relentlessly while terrorists on the ground cut off electricity, water, gas, food, and other essential supplies.

AP would also report on the starvation of Sirte in its article, “U.N. Warns Libya Is Short of Water, Fuel, Medicine:”

Rebel commanders have been negotiating with tribal leaders in Qaddafi’s hometown of Sirte, hoping to avoid further bloodshed. They announced Thursday that they had extended the negotiations’ deadline for another week, from this coming Saturday.

“We want to save our fighters and not lose a single one in battles with Qaddafi’s forces,” said Mohammed al-Rajali, a spokesman for the rebel leadership in the eastern city of Benghazi.

“In the end, we will get Sirte, even if we have to cut water and electricity” and let NATO pound it with airstrikes, he said.

And despite the title of the report, the UN made no mention of the tactics of the terrorists and their NATO backers. Instead, the UN was more concerned with aiding areas of the nation already taken by NATO’s proxy army.

In 2011, the general consensus appeared to be that cutting off an entire city surrounded on all sides by desert and sea, constituted a “humane” and “peaceful” means of taking the remaining strongholds of the overthrown Libyan government. How times and the sensibilities of the West have changed…
The Syrian Arab Army Surrounds Al Qaeda
It is now the end of 2013, with the conflict in Syria having dragged on for three years. The Syrian government has decisively turned the tide against waves of NATO-backed foreign terrorists and their extremist collaborators within the country, having restored order in many parts of the country and having surrounded the terrorist proxies in a dwindling number of districts across the Syria.

In some areas, the terrorists have been completely surrounded, cut off from reinforcements and supplies. Just as in Libya, the Syrian Arab Army is waiting for the terrorists to be starved out rather than attempt a bloody assault – the difference being that civilians – women and children – most certainly are allowed (at least by the Syrian government) to leave the besieged areas, leaving the terrorists alone.

Reuters attempts to frame the Syrian government as obstructing aid and intentionally leaving women and children to starve and freeze to death. In its article titled, “Syria uses red tape, threats to control UN aid agencies,” it states:

Syrian government is accused of using hunger as a weapon of war against its people and preventing U.N. aid staff in delivering food and medicines to rebel-held suburbs.

Reuters continues (emphasis added):

As the United Nations launched an annual appeal on Monday to help 16 million people affected Syria’s civil war, divisions among world powers that have crippled peacemaking are also denying UN staff the power to defy President Bashar al-Assad’s officials and push into neighbourhoods now under siege.

“In government-controlled parts of Syria, what, where and to whom to distribute aid, and even staff recruitment, have to be negotiated and are sometimes dictated,” said Ben Parker, who ran the UN Office for the Coordination of Humanitarian Affairs (OCHA) in Syria for a year until last February.

“According to the Syrian government’s official position, humanitarian agencies and supplies are allowed to go anywhere, even across any frontline,” he wrote last month in the journal Humanitarian Exchange. “But every action requires time-consuming permissions, which effectively provide multiple veto opportunities.” Fighting and rebel groups are also obstacles.

The United Nations appealed for $6.5 billion on Monday to help 16 million people affected by the Syrian civil war, including millions made hungry and homeless by the conflict soon entering its fourth year. The world body estimates about a quarter of a million Syrians are living under siege as winter bites, most of them encircled by government forces, but also including 45,000 in two towns in the north that are besieged by anti-Assad rebels.

A binding Security Council resolution could formally oblige the authorities to let aid agencies into areas like the Damascus suburbs and the old city of Homs, where local doctors say children are dying of malnutrition. But divisions between Western powers, backing the rebels, and Russia, have paralysed the world body over Syria since the conflict began in 2011.

Of course, Reuters excuses itself once again from having to qualify any of its claims – particularly those regarding the intentional starving and freezing of women and children. It does so by stating:

Lack of access for independent agencies makes it hard to verify food and medical supplies in many areas. But opposition activists have posted video of the bodies of several skeletal children who local doctors say died of malnutrition.

Once again, accusations of the Syrian government’s “crimes against humanity” are solely based on the “activists say” school of journalism, where “rebel” propagandists renowned as serial liars, have posted videos of unverified footage then reported as fact by their Western collaborators – with disclaimers later buried deep within reports.

What the West is Using the UN for this Time

This is being done in conjunction with plans to drop the pretense of “moderate rebels,” and fully back Al Qaeda and other extremist fronts through a network of proxies including Saudi Arabia, Qatar, Turkey, and Jordan.

In a recent e-mail leak released by the Syrian Electronic Army (SEA), correspondences between US contractor Matthew Van Dyke and Western journalists revealed that in addition to intentionally deceiving the  public regarding the nature of the conflict, aid shipments were being used to smuggle in equipment, fighters, and weapons.
Van Dyke being an armed militant himself, along with those in his company, riding freely back and forth between Libya and Syria on aid ships should raise suspicions at the very least regarding “aid” the UN plans to provide entrapped terrorists.

Stories like Alakhbar English’s “Qatar Red Crescent Funds Syrian Rebel Arms,” also raises immense concern about so-called aid flowing into Syria specifically to help those fighting the government. The article reports:

Sources in the investigation team said that Mahmoud confessed to receiving around $2.2 million from Khaled Diab, a Qatar Red Crescent official. He was then to hand the money over to a Lebanese cleric identified as O.O., born in 1983 and affiliated with Muslims Without Borders, in the Bekaa village of Bar Elias.

“Through the cleric, Mahmoud was able to acquire 30 RPG launchers for $900,000 and 300 shells for $300,000, which were then transferred to Syria by a smuggler known as Anwar or his nom de guerre Abu Salah.” The smuggler then handed over the weapons to the Syrian national known as Abu Abdullah in the Damascus countryside.

Mahmoud also bought 100 Kalashnikovs and an ammunitions cache for $40,000 from the Ain al-Hilweh Palestinian refugee camp in southern Lebanon. The source added that Mahmoud entered the refugee camp with the Syrian national Mohammad Abdullah, known as Abu Hamza, under the guise of distributing humanitarian aid to refugees from Syria.

One can only imagine what will be bought and done with the $6.5 billion the UN has called for to assist those in terrorist-held territory. It will most likely be fed directly into the terror networks the NATO and its regional allies have been preparing to expand.

Should the UN decide to truly care about ending the ongoing catastrophe that is the proxy invasion of Syria by foreign-backed terrorists, it could always point out the true nature of the conflict and hold those responsible for it, NATO and its regional axis, fully accountable. Anything less is but a criminal rouse meant to intentionally perpetuate the conflict and give the West yet another chance to end it on terms they find favorable.

Malta: Europe’s ‘last man standing’ against abortion

ROME, December 16, 2013 (LifeSiteNews.com) – With Ireland having passed its law allowing abortion, without gestational age limits, in cases where a woman threatens suicide, the tiny island nation of Malta has become the European Union’s last man standing against abortion.

Malta’s MEPs were among a small bloc at the EU who worked against the recent failed proposal by socialists and abortion activists that would have forced member states to consider direct abortion a “right”. But a December 12th op-ed in the Times of Malta warned that the Estrela Report is not going to be the last attempt to impose the rest of Europe’s abortion regime on their country.

“The daily sifting through pro-life articles makes me feel uneasy at the status quo of the pro-life work being done in Malta. Are we doing enough by way of educating our society as regards building a culture of life? Are we getting prepared for the next onslaught by some EU body on Malta,” Miriam Sciberras asked.

She pointed out that countries are enacting laws “to justify the most heinous crimes” in the name of “choice, freedom, homophobia and compassion,” with the “real meaning of the words” being “twisted to mean exactly the opposite of what it should mean.”

“Times are upon us when we should be prepared and vigilant,” she said.

The razor-thin vote on the Estrela Report, that would also have imposed explicit “sex education” on four year-old children, was 334 in favour, 327 against and 35 abstentions. The rejected report recommended that “as a human rights and public health concern, high-quality abortion services should be made legal, safe, and accessible to all within the public health systems of member states, including to non-resident women, who often seek these services in other countries because of restrictive abortion laws in their country of origin.”

Maltese MEPs instead supported an alternate resolution stating that “the formulation and implementation of policies on sexual and reproductive health and rights and on sex education in schools is a competence of the member states.”

While Malta, an overwhelmingly Catholic country, is signatory to one of the UN’s key abortion-promoting agreements, the country has stood up to the international abortion lobby from the start. When becoming signatories of the Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW), Malta included formally defined “reservations” as a condition of ratification, saying that it does not consider itself bound by one particular paragraph insofar as it “may be interpreted as imposing an obligation on Malta to legalize abortion.”

Most of the EU’s 28 member states allow abortion “on request” and most have the gestational age limit set at 12 weeks. Exceptions are Ireland, that now allows abortion in some circumstances with no gestational time limits, and the UK that has its limit set at 24 weeks for children with no diagnosis of disability, one of the highest in the EU. In the UK eugenic abortion, for those children suspected of a disability, is allowed without restriction up to full gestation.

Sciberras pointed out that in Ireland a Catholic hospital is already being forced by the government to participate in abortion, despite the EU’s own rights agreements protect religious conscience rights.

“Our government and legislators should be alerted to this test case,” she wrote, calling it a “blatant example of what happens when the ‘liberals’ impose their stance on all and do not allow anyone to disagree in principle, ethos or religious conscience.”

She warned also that the “liberal wing in Malta’s political parties also seems to be gaining the upper hand”.

“Maltese politicians and Church leaders should be fully aware of what this really means before it is too late for Malta. Liberal laws are not really liberal when those who disagree are threatened or coerced into complying.

“Woe to us, should European law fail to protect religious conscience for whatever concocted reasons.”

Jihad on Jesus: Militants Firebomb New Christ Statue and Ancient Monastery, Syria

Earlier this month, the Islamist-led opposition in Syria broadcast a video clip of a militant threatening the nation’s Christian minority, with a focus on the Cherubim monastery and the large Jesus statue recently erected in the region of Saidnaya in Damascus.

In the video, images of militants firing rockets at the ancient monastery and setting the building on fire appear (confirmed elsewhere). The Christ statue also appears being targeted, though it is unclear if it was damaged.

The 128-foot tall bronze Christ statue, christened “I have come to save the world,” was recently erected in war-torn Syria, with support from the Russian Orthodox Church.

Throughout the video clip, Islamic chanting is heard and Koran verses recited, including those vowing destruction to all polytheism (shirk), a reference to Christianity.

After the speaker in the video accuses Syria’s Christians of being supportive of the secular Bashar Assad government, he declares: “The swords of Islam shall fall upon your necks in your own monasteries, Allah willing—and Allah is witness to our words!”

The Case That Could Topple Obamacare

Obamacare may have its problems, including more bugs than you can find in the cornfields of Nebraska, but its legal worries were meant to end after the Supreme Court upheld the individual mandate, the heart of the Affordable Care Act.

Now, as the technologists charged with making healthcare.gov work report progress, lawyers are re-entering the fray. A little-heard of challenge currently making its way through the court system may represent opponents’ last best hope of, as they are fond of saying, driving a stake through the heart of the law.

It all started in 2011, when Jonathan H. Adler, a conservative law professor at Case Western Reserve University in Ohio, shot an email to his friend Michael Cannon, a health policy expert at the libertarian Cato Institute in Washington, D.C. Adler thought he had spotted an error in Obamacare that could unravel a significant portion of the law.

At issue are the federal subsidies for individuals buying insurance in their state’s health care exchanges. The law stipulates that those subsidies should be allotted for plans purchased “through an Exchange established by the State under Section 1311” (italics added), a reference to the section of the law that establishes state-run exchanges.

Adler wondered: Did the law provide subsidies for only state-run exchanges and not federal ones? The law requires that the federal government step in to create an exchange when a state declines to do so. But does it fail to give subsidies to the residents of those states?

It may seem like a small problem, but if true, it spells disaster for the Affordable Care Act. Without subsidies, health care on the individual market becomes unaffordable. Without an affordable option, the individual and employer mandates disappear. In other words, the entire law could come crashing down in the 36 states that have opted not to run their own exchanges.

Since its passage in March 2010, the Obama administration has set about implementing the law by making the subsidies, in the form of premium assistance tax credits, available in every exchange no matter who was running it. The Internal Revenue Service, which oversees this piece of the law, finalized a rule allowing subsidies in every state in May 2012.

Meanwhile, Adler and Cannon recorded their finding in a Wall Street Journal op-ed in November 2011. The IRS was acting against the plain language of the law, they argued. As Cannon tells it, the duo then decided to do more research, which led them to believe that this was not, as they had called it in the Journal, a “glitch.” Instead, they argue Congress intentionally decided to withhold subsidies from federal exchanges.

Constitutionally, the federal government cannot order states to create the exchanges, so Adler and Cannon contend that Democratic lawmakers intentionally withheld premium assistance to strong arm states into implementing their own exchanges. Though this is not explicitly stated in the law, Cannon and Adler point to a handful of comments that they argue infer subsidies were intended for state-run exchanges – but there is no explicit evidence. Now that 36 states decided not to create their own exchange, Cannon and Adler maintain that the IRS is not carrying out the letter of the law.

“President Obama is trying to do the exact opposite of what the law says,” Cannon said.

The two drafted a paper in the first half of 2012 on their findings, but didn’t publish because they thought the Supreme Court might overturn the whole thing anyway. When the court largely upheld the law, the two published their paper in July 2012. Over a year later, there are now four cases challenging the subsidies in federally-run exchanges. One of them, Halbig v. Sebelius, was argued in D.C. district court this month by premier conservative litigator Michael Carvin.

“This is literally the simplest case I’ve ever had in 30 years of practicing law,” Carvin said at a Cato event this summer. “No one but a lawyer could seriously stand up here and tell you that north means south, black means white and state means federal. And all you need to do is read the statute and know that that is what the law is.”

Carvin may be confident, but critics have variously called Cannon and Adler’s theory “preposterous,” “screwy” and a “Republican fantasy.”

“I think it’s a case without merit,” said Sara Rosenbaum, a health care expert at George Washington University. “The plaintiffs have seized on a few words in a statute, they’ve taken the words completely out of context, and they have ignored numerous other parts of the statute that make their interpretation of the law basically senseless.”

Defenders of the law argue that the phrase “established by the State under section 1311” does not exclude federally-run marketplaces. Their legal argument is simple: the law defines an “Exchange” as established by the state, then orders the federal government to establish the exact same exchange, denoted as “such Exchange,” if a state fails to act. In other words, it authorizes the government to act as the state and set up an exchange as it is defined in section 1311. Whether a particular section of the law references an “Exchange” or an “Exchange established by the state” is the same thing as referring to the law variously as the “Affordable Care Act” and “Obamacare,” two terms with identical meaning, because a federally-run exchange is, for the purposes of the law, the same as a state-run exchange.

“[T]here is nothing extraordinary about the Secretary acting for, or stepping into the shoes of, or standing in for, or representing, the State,” former Justice Department lawyer Rob Weiner wrote in an amicus brief in Carvin’s case. “This type of legal substitution happens all the time.”

The law’s opponents don’t buy this explanation, but it’s judges whose opinions ultimately matter. D.C. District Judge Paul L. Friedman could weigh in at any time, kicking the case up to the D.C. Circuit Court of Appeals and then, potentially, the Supreme Court. Carvin and his team are hoping the D.C. court will rule quickly because on January 1, coverage under the exchanges begins. After January 1, 2014, rulings in these suits could create chaos, halting subsidies that are already being handed out.

Supporters of the law are even more confident in taking on the second part of Cannon and Adler’s thesis: That Congress purposefully decided to withhold subsidies from individuals in federally-run exchanges, thereby allowing Republican state officials to single-handedly void the law in their states.

“To believe their argument, you have to believe that [top Democratic Senators] Harry Reid and Chuck Schumer and Patty Murray and Max Baucus got together off the Senate floor one day and said, ‘I know what we’ll do to convince these states that they should set up exchanges: We’ll give them the power to completely destroy at least the exchange portion of Obamacare in their states,’” said Simon Lazarus, senior counsel at the left-leaning Constitutional Accountability Center who has taken a leading role in repudiating Cannon’s work. “People think a lot of things of those individuals, but dumb is not one of them.”

Lazarus, who watched the oral arguments in Washington this month, said Carvin spent a considerable amount of time on the issue of congressional purpose because “the text argument just doesn’t get him across the finish line,” as he put it. “They need this purpose argument. They can’t just get away with saying there was a glitch in the statute.”

Under longstanding Supreme Court precedent, agencies have broad authority to implement laws according to their reading of the statute. So it is not enough for opponents of Obamacare to prove there are ambiguities in the statute. To win, Carvin must convince the court that the meaning of the text is beyond doubt.

Cannon, Adler and Carvin argue that Congress uses the carrot-and-stick approach all the time to induce states to enact programs they cannot simply require them to enact, the most famous example being Medicaid, which states administer in order to receive funding.

But Team Obamacare has a convincing rejoinder to this point: If you are going to condition tax credits on participation, why would you not make this explicit?

“A threat can’t be kept secret,” Lazarus said at the Cato event. “By its very nature, a threat must be communicated. There is no such thing as a stealth threat.”

And there is no evidence states intended to decline billions in subsidies when they decided not to set up exchanges. “You can’t find any evidence that any of them debated the fact that if they opted out it would cost their residents all of their premium assistance,” Rosenbaum said.

Opponents may dismiss the conservative argument as a joke, but no one is laughing at the risk the case poses for the health care law. That’s a lesson they learned the hard way. During the first challenge to Obamacare, liberals scoffed at the legal arguments created to undo the law, only to see the law nearly toppled by the Supreme Court.

“I think you have to take every case seriously,” Rosenbaum said. “You have to take courts very seriously.”

If this case fails, Obamacare will continue on the road to ruining the United States of America which will make many people happy but what will come after is the bigger question… People I know are concerned that come the New Year they’ll become part time workers because of Obamacare – the number of workers are being reduced to part time work as we speak since business’ are getting ready for the onslaught of this horrendous redistribution markist bill which will fundementally change the country, as promised by the Selfer himself during his initial run as a candidate for the highest office in the nation.
